Welcome to Ether.store. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User") and Ether.store ("we," "us," or "our") governing your access to and use of our website, platform, smart contracts, and related services (collectively, the "Services").
Ether.store enables users to create and deploy ERC-20 tokens on the Base blockchain with automated liquidity pool creation through Uniswap. By connecting your wallet, creating a token, or otherwise using our Services, you acknowledge that you have read and agree to be bound by these Terms and our Privacy Policy.
Important: Please read these Terms carefully before using our Services. If you do not agree to these Terms, you may not access or use the Services.
1. Acceptance of Terms
By connecting your wallet, creating a token, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Eligibility
To use our Services, you must:
- Be at least 18 years of age or the age of majority in your jurisdiction
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using our Services under applicable laws
- Not be located in, or a citizen or resident of, any jurisdiction where use of our Services would be prohibited
3. Description of Services
Ether.store provides a platform for:
- Creating and deploying ERC-20 tokens on the Base blockchain
- Automatic liquidity pool creation on Uniswap
- Earning and claiming creator rewards from trading fees
- Discovering and trading tokens created on the platform
4. Wallet Connection
To use certain features of our Services, you must connect a compatible cryptocurrency wallet (such as MetaMask or Phantom). You are solely responsible for:
- Maintaining the security of your wallet and private keys
- All activities that occur through your connected wallet
- Ensuring you have sufficient funds to cover transaction fees
5. Token Creation
5.1 Your Responsibilities
When creating a token on Ether.store, you represent and warrant that:
- You have the right to use any names, logos, or content associated with your token
- Your token does not infringe on any third-party intellectual property rights
- Your token is not designed to defraud, scam, or deceive others
- You will comply with all applicable laws and regulations
5.2 Prohibited Activities
You agree not to create tokens that:
- Impersonate other projects, individuals, or entities
- Contain misleading or false information
- Promote illegal activities or violence
- Violate intellectual property rights
- Are designed to manipulate markets or defraud users
6. Fees and Payments
Our fee structure is as follows:
- Token Creation: Free (you pay only network gas fees)
- Trading Fees: 1% fee tier on all Uniswap liquidity pools
- Creator Rewards: 80% of collected LP fees go to creators, 20% to the platform
All fees are subject to change. Updated fee information will be posted on our Fees page.
7. Risks
Cryptocurrency and token trading involves substantial risk of loss. You should not trade or invest funds you cannot afford to lose.
By using our Services, you acknowledge and accept the following risks:
- Market Risk: Token values can fluctuate significantly and may lose all value
- Smart Contract Risk: Smart contracts may contain bugs or vulnerabilities
- Regulatory Risk: Laws and regulations regarding cryptocurrencies may change
- Technical Risk: Blockchain networks may experience congestion, forks, or failures
- Liquidity Risk: You may not be able to sell tokens when desired
- Loss of Funds: Transactions are irreversible; lost private keys cannot be recovered
8. No Investment Advice
Nothing on our platform constitutes financial, investment, legal, or tax advice. We do not endorse or recommend any specific tokens. You are solely responsible for conducting your own research and making your own investment decisions.
9. Intellectual Property
The Ether.store name, logo, and all related graphics, software, and content are owned by us or our licensors. You may not use our intellectual property without prior written consent. You retain ownership of content you create (such as token names and logos), but grant us a license to display and distribute such content through our Services.
10. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF INFORMATION
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ETHER.STORE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- LOSS OF PROFITS, DATA, OR GOODWILL
- LOSS OF TOKENS OR CRYPTOCURRENCY
- SERVICE INTERRUPTION OR COMPUTER DAMAGE
- COST OF SUBSTITUTE SERVICES
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.
12. Indemnification
You agree to indemnify and hold harmless Ether.store and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Tokens you create on the platform
13. Modifications to Services
We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice. We may also modify these Terms at any time. Continued use of the Services after changes constitutes acceptance of the modified Terms.
14. Termination
We may terminate or suspend your access to the Services at any time, without prior notice, for any reason, including if you violate these Terms. Upon termination, your right to use the Services will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
16. Dispute Resolution
Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive your right to a jury trial and to participate in class action lawsuits.
17. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy and Fee Schedule, constitute the entire agreement between you and Ether.store regarding the Services.
19. User Conduct
You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Services in any way that violates any applicable federal, state, local, or international law or regulation
- Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services
- Use the Services to transmit any advertising or promotional material without our prior written consent
- Impersonate or attempt to impersonate Ether.store, an Ether.store employee, another user, or any other person or entity
- Use any robot, spider, or other automatic device to access the Services for any purpose
- Introduce any viruses, trojan horses, worms, or other malicious or technologically harmful material
- Attempt to gain unauthorized access to any portion of the Services or any systems or networks connected to the Services
- Interfere with the proper working of the Services or take any action that imposes an unreasonable load on our infrastructure
20. Platform Rules
In addition to the prohibited token activities described above, you agree to abide by the following platform rules:
- Do not engage in wash trading, market manipulation, or any form of artificial trading activity
- Do not create multiple accounts or tokens for the purpose of circumventing platform rules
- Do not exploit any bugs, glitches, or vulnerabilities in our smart contracts or platform
- Report any security vulnerabilities you discover to our team immediately
- Do not use the platform to launder money or finance illegal activities
- Comply with all applicable anti-money laundering (AML) and know-your-customer (KYC) requirements
21. Third-Party Links and Services
Our Services may contain links to third-party websites, services, or resources that are not owned or controlled by Ether.store. These include but are not limited to:
- Wallet providers (MetaMask, Phantom, etc.)
- Decentralized exchanges (Uniswap)
- Blockchain explorers (Basescan)
- Social media platforms
We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Ether.store shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such third-party content, goods, or services.
22. Electronic Communications
By using our Services, you consent to receive electronic communications from us. These communications may include:
- Service announcements and updates
- Security alerts
- Transaction confirmations
- Changes to our Terms or policies
You agree that all agreements, notices, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
